The law protects bona fide purchasers of housing

The state Duma adopted a law that recognizes bona fide purchasers of the property of those who bought it from the crooks, taking into consideration information from the state register. About it reports "RIA Novosti".

 

The bill proposes to establish a ban on solicitation by the state (the Russian Federation, subject of the Russian Federation or a municipal unit) dwelling, disposed of his property, a bona fide purchaser-citizen. This provision should be extended including bona fide purchasers who obtained the property free of charge.

 

Also enshrined in the civil code the presumption of good faith of the person relied on the data of the state registry. States that a bona fide purchaser of real property is one who upon its acquisition relied on the data of the state register, while in court it is not proved that he knew (or should have known) about the absence of law on the alienation of property from the person from whom it has taken over property rights.

 

In addition, be advised that the period of acquisitive prescription begins from the date of receipt of the goods into the possession of a bona fide purchaser, and in the case that it was the right of ownership not later than the date of state registration of rights.

 

It is planned that the changes will take effect from the beginning of 2020.
